Debate Foreclosure Law; Event Promises Lively Discussion

WESTON, FL (PRWEB) September 26, 2013

From Wall Street to Main Street, attorney Roy Oppenheim, a thought-leader in the area of foreclosure defense and the founder of the South Florida Law Blog, will hold court with three Broward County Circuit Court judges providing his unique perspective on South Florida’s foreclosure crisis.

Oppenheim, who led the fight against the Florida Bar earlier this year concerning its support of new foreclosure legislation, will serve as the only attorney on a three-judge panel to discuss and likely engage in a lively debate about: “What judges want foreclosure attorneys to know.”

His distinguished colleagues from the bench are Judge John B. Bowman, Judge Mily Rodriguez Powell and Judge William W. Haury Jr.

Oppenheim also will serve as keynote speaker at the event, which will take place Oct. 11 from 9 a.m. until 12 p.m. at the Broward Center for the Performing Arts. The event is part of a series of seminars put on by the Daily Business Review and for which Oppenheim Law is a Platinum sponsor.

During the last year, several newspaper articles have referred to Oppenheim as a “real estate defense attorney.” While there is no such practice area per se, “with so many people facing the prospect of losing their homes to banks, it seems fitting that this new category of law has been created by the media,” says Oppenheim.

Oppenheim law has successfully defended numerous homeowners facing foreclosure against banks that have attempted to violate the rules of civil procedure and the rules of evidence by presuming homeowners are guilty or liable prior to having their full day in court.

Oppenheim also has been an outspoken critic of HB 87, known as the fast-track foreclosure legislation, which was passed earlier this year by the Florida Legislature and signed into law by Gov. Rick Scott.

“Ultimately, the bill that passed is a hodgepodge of elements that likely will gum up the foreclosure process because there are parts of it that are either unconstitutional or sufficiently ambiguous so that controversies will linger on in the appellate courts for years,” says Oppenheim.
