Zombie foreclosures continue: Zombies aren’t after us, they’re in charge of us

470_1661157Recently, we won a court victory against one of the nation’s biggest financial players.

Our client, who had a $2.5 million mortgage, stopped making payments after the bank forced placed insurance on the home, even though he already had insurance. Forced placed insurance is a policy that, as the name implies, is placed on a home when the homeowner’s own policy either has lapsed or the bank decided it’s not sufficient.

Just before our client was about to get a “directed” — or favorable — verdict from the judge, the bank fell on its sword and dismissed the suit, recognizing it was about to lose the case because it was unable to prove that it had the proper documentation needed to legally foreclose on the home.

But this win could be short-lived since our client can still fall victim to what is quickly becoming known as a “zombie foreclosure.” As the name suggests, these zombie foreclosures are even more of a nightmare than your basic, everyday foreclosure.

Thousands of homeowners have and continue to become victims of zombie foreclosures — liable for homes they didn’t even know they owned after lenders decided not to pursue a foreclosure after all.

As I have written about previously, banks have been walking away from foreclosures with impunity because it simply isn’t worth their time or money to pursue them. Because there are no regulations in place that say the lenders must tell the homeowner that they have changed their mind about the foreclosure, borrowers are still on the hook — not only for the mortgage on a home they may, or may not, live in, but also any property taxes, homeowner association fees, etc.

The Walking DeadGrave robbers and zombie foreclosures. They are back, not that they were ever really gone.

Like Freddy Krueger, Jason Voorhees, and Jigsaw, they just keep coming back, even though no one really wants them to. And even when the homeowner manages to escape a “haunted” home, it isn’t always the end of the story — case in point, the story of Joseph Keller, victim of the newest villain, the “Zombie Title.” Even for those with a strong stomach, stories like this will make your head spin. He was evicted from his Ohio home, or so he thought.

He received word from his lender that his home was being put up for auction, and so he left. Except the sale never happened, and now the debt collectors are coming after him for back taxes, sewer removal, and other bills because the home is still in his name.

It’s a limbo where your mortgage keeps coming at you, even from beyond the grave.

As an attorney I’ve been dealing with zombie foreclosures for a number of years. A zombie foreclosure starts out like any other case.

Many times we’ve been successful in getting the foreclosure dismissed because of illegal or egregious conduct by the banks for various reasons, such as the lender’s counsel failing to prove that they owe the note or that the transfers were done properly.

Or perhaps there was robosigning or fraud or some other technical, legal, or constitutional reason why the foreclosure was bad. And in at least 20 percent of those cases, the case gets dismissed.

The Real ‘Miami Zombie’ — David Stern!

Rudy EugeneWe’ve all heard by now of the unbelievably grizzly story out of Miami about Rudy Eugene, the man so off his gourd that he ate a man’s face off.

Somewhere along the line this horrific attack became the source of comic fodder. Eugene’s been dubbed “The Miami Zombie,” and yes he even has a Twitter account.

But I might argue that there is another man worthy of that title, and his crimes, while not as physically grotesque, are none the less revolting.

I am talking about David J. Stern. The actions of Stern and his firm are continuing to have an impact on my cases, and over a year after his firm closed, the lasting effects of its shady practices are still reverberating throughout Florida.

A revised class action lawsuit was filed last week against Stern, his former CFO and the law firm he founded by two hedge funds who are accusing Stern of ripping them off.

So not only do we have a story about zombies, but we have cannibals to boot! The people who once trusted Stern have turned on him, and once again we have the banks ‘eating’ their own!

The former head of one of largest foreclosure mills already had a less than sterling reputation, but after reading the latest allegations against Stern and his cohorts at DJSP Enterprises, Inc., I’d (playfully) argue he really is a zombie, because how he ripped off countless homeowners is TRULY disgusting and his actions continue to harm homeowners to this day.
