Last week was quite a week. I left Cambridge, MA, after visiting my daughter for the weekend and enjoying a little family rivalry at the Harvard – Princeton football game.

After a meeting in New York, I found out the nationally syndicated Randi Rhodes Show wanted me to make an appearance at 5 p.m. to discuss foreclosures and Oppenheim Law’s defense strategies. They would not let me use my cell phone for the interview, so I was expecting to have to talk from a pay phone in the middle of LaGuardia before my flight back to South Florida. Luckily, I found a quiet place and the interview was great.

We’ve included audio of the entire interview on the Oppenheim Law Facebook Fan Page for your listening pleasure, but here is a summary of my thoughts on the social stigma of foreclosure and how you can fashion your own bailout:

I believe the foreclosure epidemic has become so widespread and far-reaching that the stigma surrounding the issue is greatly reduced across the country.

“In FL alone we now have 26-28% who are behind or in foreclosure,” I said. “I think if you study social networks, you’ll see that foreclosures work like social networks. When you have someone who’s in foreclosure, the moral stigma is reduced because you have a sense of kinship.”

So in response to the enormity of the problem in South Florida, I explained that foreclosure defense needs to be looked at holistically, and homeowners need to take charge of understanding their legal rights and defending themselves.

Goldilocks and the Three Bears: Here We Go Again “The New Normal: Foreclosures Not Abating Until 2013

After reviewing the recent numbers for 2009 published by RealtyTrac, nothing is “just right” and won’t be for some time. With foreclosures on the rise in 2009, the new “three bears” to hit the market have nearly doubled the number of foreclosures this year, and the trend will not be ending anytime soon.

The highest growth in the foreclosure market has been a result of three types of foreclosures; (1) delayed sub-prime foreclosures from 2008; (2) higher default rates on Option ARM loans, and (3) a significant rise in unemployment related foreclosures. With numbers indicating that 1 out of every 6-10 unemployed will face foreclosure, Goldilocks better find somewhere else to take a nap because there won’t be many family-owned homes left when the dust settles.

The “new normal” appears to be a staggering number of foreclosures, and is not expected to return to pre-recession figures until 2013. Foreclosures are expected to rise the rest of the year, and peak throughout 2010 and 2011. In Florida, we can expect to have about 40-50% of the foreclosures in the country, and half of these will be in South Florida. At this rate, Goldilocks will be old enough to buy her own house by the time the market rebounds.

Re: Oppenheim Pilelsky, P.A.’s comments in response to the Final Report and Recommendations on Residential Mortgage Foreclosure Cases (the “Report”) by the Task Force on Residential Mortgage Foreclosure Cases to the Florida Supreme Court (the “Task Force”)

Dear Madam Chief Justice:

It is an honor for our law firm, Oppenheim Pilelsky, P.A., comprised in part of foreclosure defense attorneys, to provide the following comments concerning the mortgage foreclosure crisis. We appreciate the amount of time and effort that the Task Force and the Supreme Court have allocated to address these important matters. In reviewing the problems identified by the Task Force and the appropriate recommendations to such problems, our comments on the Task Force recommendations are as follows:

1. We strongly agree that having uniformity of forms and procedures statewide is important to a fair and just statewide judicial system. Thus the goal of establishing a uniformity of forms and procedures statewide is important and is endorsed by our firm.

2. Establishing a central information source and a statewide web site to provide centralized information for all parties involved with a foreclosure is a good idea. Our firm’s only concern is who will fund and manage the web site in light of economic realities. Further, it is important that the web site remain neutral and not favor banks or homeowners in connection with the information provided.

I believe my friend Al Sunshine, who has been reporting for CBS4 since 1988, provided a thoughtful and honest assessment of South Florida’s economy through the next quarter in his daily blog, “Al Sunshine’s 4 Your Money.”

In short, I agree with Al that foreclosures and unemployment will continue to take a real bite out of the economy, but things will not get much worse. We hope!

Roy Oppenheim Presents Foreclosure Strategies to Pompano Beach Homeowners

More than 5,000 homes in Pompano Beach have already been foreclosed or are currently in some stage of the foreclosure process, according to Realtytrac.com.

Fully aware of the battle facing South Florida homeowners, the Pompano Beach Highlands Civic Improvement Association has announced its next meeting will be dedicated to the topic of foreclosure defense for homeowners.

The Association has invited real estate attorney and legal blogger Roy Oppenheim to outline the foreclosure process, discuss the defenses to a foreclosure action, and offer alternatives available to distressed homeowners such as loan modifications and short sales. The meeting will be held at Pompano Beach Highlands Park on Tuesday, October 6th at 7 p.m.

Foreclosed Homes A Problem During Hurricane Season

While South Florida is in the midst of hurricane season, many residents want to know who is responsible for abandoned and foreclosed homes before a storm strikes.

Luis Callard is a West Miami-Dade resident who’s worried about all the abandoned and foreclosed houses in his neighborhood.

“No one lives there, and there’s stuff in the back yard,” he tells CBS4′s Chief Consumer Investigator Al Sunshine. “What if a hurricane hits, with high winds?”

He’s not the only South Floridian who worries about that. With Florida among the national leaders in numbers of foreclosures, vacant homes and condos can be found in most neighborhoods. They’re no match for a hurricane.

Ron Szep of the Miami-Dade Building Department knows the problem.

“When the building is unsecured, when the wind can get inside that building, it will basically blow it apart. All the debris will be flying into your and your neighbors’ homes and cause severe damage.”

Szep says that’s the reason Miami-Dade County has a $200,000 program to board up abandoned homes.

So far, 120 of them have been secured, at an average cost of $3,000 each. The county eventually gets the money back by placing a lien on the property, which usually means the bank that foreclosed on the home pays the bill.

Chris Albury of the Miami-Dade Office of Neighborhood Compliance says it’s a good program, but it doesn’t happen overnight.
